Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Pluvika at pluvika.com and related services (the “Service”). The Service is operated by FMP Digital Solutions, a sole establishment registered in Abu Dhabi, United Arab Emirates (Economic Licence No. CN-6617899) (“Pluvika”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms.

1. What Pluvika is

Pluvika is software that lets a business create a catalog page. Visitors browse that page and then order from or enquire with the business through the business's own WhatsApp.

Pluvika provides the software only. We are not a marketplace, a delivery service, or a payment processor for your sales, and we are not a party to any transaction between a business and its customers. Any order, payment, fulfilment, return, or dispute is solely between the business and its customer.

2. Your account

You must be able to enter into a binding contract to use the Service. You agree to provide accurate information and to keep it up to date. You are responsible for your account, your login credentials, and all activity that happens under your account.

3. Your content

You keep ownership of the content you upload — your business details, products, photos, and text (“Your Content”). You grant us a worldwide, non-exclusive licence to host, store, and display Your Content for the sole purpose of operating the Service for you.

You are responsible for Your Content. You confirm that you have the right to use it (including any images), that it is accurate, and that it is lawful. You are responsible for your prices, your product information, and your communications with your customers.

4. Acceptable use

You agree not to use the Service to:

• break the law or sell goods or services you are not permitted to sell;
• post content that is fraudulent, misleading, infringing, or harmful;
• upload malware, attempt to gain unauthorised access, scrape, overload, or otherwise disrupt the Service;
• impersonate any person or business or misrepresent your affiliation;
• violate the terms of any third-party service you connect to, including WhatsApp.

5. Plans, billing, and renewals

Pluvika offers a free plan (Starter) and paid plans (Pro and Business). Current prices are shown at pluvika.com/pricing. Paid subscriptions are billed through Polar (Polar Software, Inc.), our Merchant of Record, and renew automatically each billing period until you cancel. Any applicable taxes are handled by Polar. We may change our prices from time to time; changes apply from your next renewal, and we will give you reasonable notice.

6. Cancellations and refunds

You can cancel at any time. Please see our Refund & Cancellation Policy for the details.

7. “Powered by Pluvika”

Pages on the free plan display a small “Powered by Pluvika” link. Paid plans may remove it.

8. Availability and changes

The Service is provided on an “as is” and “as available” basis. We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free, and we may add, change, or remove features over time.

9. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate an account that breaches these Terms, or where we are required to for legal or security reasons.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind. We are not responsible for transactions, communications, or disputes between a business and its customers, or for the content that businesses publish.

11. Limitation of liability

To the maximum extent permitted by law, FMP Digital Solutions will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.

12. Indemnity

You agree to indemnify and hold harmless FMP Digital Solutions from any claims or demands arising out of Your Content, your use of the Service, or your breach of these Terms.

13. Not affiliated with WhatsApp

Pluvika is an independent product and is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc. “WhatsApp” is a trademark of its respective owner.

14. Governing law

These Terms are governed by the laws of the United Arab Emirates, and the courts of Abu Dhabi have jurisdiction over any dispute, without regard to conflict-of-law rules.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version here and revise the “Last updated” date. Continued use of the Service after changes take effect means you accept the updated Terms.
